WHO WE ARE

“Rendin” is Rendin Polska sp Address ul.Twarda 18, 00-105 Warszawa.

Rendin provides an information society service through the Rendin app and website www.rendin.pl that enable concluding residential home rental agreements between Landlords and Tenants. The purpose of the service is to make the contracting and tenancy process fair, safe, and efficient for all parties involved. 

The Rendin service may include help with prospecting and screening of tenant candidates, digital contracting and handover, digital signing, preventive customer support and guidance, adjudication in case of disputes, legal support, handling and collecting of Tenant debts to the Landlord in case of arrears.   

Rendin is not an insurance, loan, or property management service to any parties. Rendin prevents and solves problems emerging from financial risks, misinterpretations of laws and regulations, and miscommunication between the parties during the tenancy.

GENERAL CONDITIONS

This website is operated by Rendin. Throughout the site, the terms “we”, “us” and “our” refer to Rendin service. By using our website or platform/app you agree to the following terms and conditions (“Terms of Service”, “Terms”) and Privacy Policy. This includes additional terms and policies referenced herein or available by hyperlink. If you do not agree to all the terms and conditions listed, you may not access the website or use any of our services.

Any new features or tools which are added to the current product shall also be subject to the Terms of Service. Using Rendin services may mean downloading the mobile application (“our app”). The customer agrees for Rendin to automatically renew the app’s content.

By using our services you consent to receive notifications from us electronically to the e-mail address you provide to us. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. 

LEGAL RESTRICTIONS TO CLIENTS

All users of the Rendin platform/app must be at least 18 years old to be able to act as Tenants, Landlords, and Real Estate Agents. You must also have the legal capability to submit and sign rental agreements and use our Solution service. We reserve the right to refuse service to anyone for any reason at any time.

The customer confirms that all information submitted to Rendin’s platform regarding user profile and contract objects is up to date and relevant at all times. All Customers using Rendin Service, are obliged to keep contract details and parties’ personal information confidential.

REGISTRATION AND SECURITY

As a part of the registration or account creation process, you will create login credentials by selecting a password and providing an e-mail address or by linking another account, such as your Apple, Facebook, or Google accounts. You may also be asked for other necessary information.

Each registration is for a single user only. You are not allowed to share your registration login credentials or give your login credentials to anyone else. You are responsible for maintaining the confidentiality of your password, which you will not have to reveal to any representative. Failing to do so may result in immediate suspension or termination of your account.

Please notify info@rendin.pl of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security.

CLOSING USER ACCOUNTS

Rendin can close a customer's account, any time without any pre-notification in case Terms of Service have been violated.

OUR PRODUCT AND SERVICES 

The Rendin app and website are meant for concluding electronic Rental Agreements between the Landlord (or the Landlord's representative) and the Tenant. The Landlord can use the help of a Real Estate Agent or another trustee representing them as a Creator. 

The Creator in the Rendin app facilitates the filling of the agreement data and the signing process between the parties. The Creator is mostly a professional Real Estate Agent. Rendin is not responsible for the Creator and the information inserted by the Creator. 

Landlords and Tenants can meet on the Rendin app or website, and we may match them through our network. Tenants can pass the Rendin service solvency check to get the safety mark for the trust matters to the other Party with their consent.  

The Handover functionality in the app is a part of the Rendin service to ensure evidence-based adjudication and fair assessment of the Landlord's property condition at the check-in, check-out, and during the tenancy, if needed.  

Rendin service is based on trust and good faith that every stakeholder of the process and service does their best to avoid disputes and misunderstandings. The common goal is to prevent problems and losses. Rendin is a center of competence and guidance of the rental process between the Landlord and the Tenant.  

For Tenants who have successfully passed the Rendin solvency check, Rendin may provide a surety to encourage the start of a tenancy with more favorable costs, i.e., deposit free. The Rendin solvency check is a free preliminary feature of the service to ensure the potential Tenant meets the requirements to conclude a rental agreement on the Rendin platform. 

Part of the Tenant screening process is the person-to-person due diligence as the responsibility of the Landlord. It means the Landlord or the representative person must exercise a reasonable check of the Tenant's identity and legal documents before the Handover is concluded and the Dwelling is handed over to the Tenant.  

Disputes arising from the rental agreement should be resolved between the Landlords and Tenants, with Rendin’s assistance and support. We provide adjudication and the best possible legal practices to solve the Parties' matters. In case of arrears, the Landlord has to notify Rendin and ask for the instructions. 

If the Tenant is not fulfilled his/her financial obligations coming from the rental agreement even after the reminders and mitigation process, Rendin will manage the debt handling covering the arrears to the Landlord up to the surety amount as well representing the Landlord in the debt collection process if needed. The Tenant is obliged to reimburse Rendin any sums paid to the Landlord by Rendin as part of the surety and all costs of debt handling.

RENDIN SERVICE FEES AND MAKING PAYMENTS

Rendin’s Service fee is 2.5% of the monthly rental payment. The payment dates are set by the Creator during the creation of the rental agreement. The dates are made known to all parties via the app or relevant invoices. 

All payments are made via a bank transfer. Cash is not accepted. In case of Agreement cancellation and prepayment of the Service fee the difference will be refunded on the basis of monthly calculation.

Prices for our products are subject to change without notice. Only exception is the service fee of the existing contracts, in such cases the service fee is valid until the end of the contract. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time.

OPTIONAL TOOLS 

We may use and provide you access to third-party tools over which we do not have full control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. 

Any use of optional tools offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms of any such tools before using them.

 We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service. 

PERSONAL INFORMATION AND DATA PROTECTION

During the use of the Services, Rendin will collect and process personal data. Data is processed in accordance with local applicable data protection laws. Further information on this can be found in the privacy policy of Rendin.

GOVERNING LAW 

These Terms of Solution service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Poland. 

CHANGES TO TERMS OF SERVICE 

You can review the most current version of the Terms of Service at any time at this page, including any possible changes and revisions. Any significant changes in the Terms will be followed by a notification to all active Users.

By using our services you take full responsibility in being up to date with the terms and conditions. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
